1. Introduction
Welcome to Gotarneaasa Technologies (OPC) Private Limited. By accessing and using our website, services, and products, you agree to abide by these Terms and Conditions.
2. Services
We provide website design and development, mobile app development, and web application development services. The scope of services, pricing, and timelines will be defined in the project agreement or invoice.
3. Payment Terms
- All payments must be made in full before project commencement unless otherwise agreed in writing.
- Milestone-based payments may be applicable for larger projects.
- Delayed payments may result in project delays or suspension.
4. Intellectual Property Rights
- The final product delivered to the client will be owned by the client upon full payment.
- We retain the right to showcase work in our portfolio unless a written NDA prohibits it.
- Third-party software licenses, themes, or plugins are subject to their respective licensing terms.
5. Revisions and Changes
- Minor revisions are included as per the project scope. Additional changes beyond the agreed scope will incur extra charges.
- Any requested changes after project delivery may be charged separately.
6. Limitation of Liability
We shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including but not limited to business losses, data breaches, or third-party service failures.
7. Termination
We reserve the right to terminate services if the client breaches these terms or engages in unethical, illegal, or fraudulent activities.
8. Governing Law
These Terms and Conditions are governed by the laws of India, and any disputes shall be resolved in the jurisdiction of Pune, Maharashtra.
Refund Policy
1. No Refunds for Completed Work
Once a project is delivered and approved, no refunds will be provided.
2. Partial Refunds
- If the project is canceled before development begins, a partial refund may be provided after deducting administrative costs.
- If work has already started, refunds will be processed based on the percentage of work completed.
3. Non-Refundable Services
- Domain registration, hosting services, third-party licenses, and any paid plugins/tools are non-refundable.
- Consultation and discovery phases are non-refundable.
4. Refund Processing
Approved refunds will be processed within 7-14 business days to the original payment method.
Cancellation Policy
1. Cancellation by Client
- Clients can cancel a project before the work begins and may be eligible for a partial refund.
- If cancellation occurs after the commencement of work, a refund will be issued based on completed milestones.
2. Cancellation by Gotarneaasa Technologies
We reserve the right to cancel a project under the following circumstances:
- Non-payment or repeated payment delays.
- Client’s failure to provide required project details or approvals within a reasonable timeframe.
- If the project is deemed infeasible due to unforeseen technical or legal reasons.
3. Effect of Cancellation
Upon cancellation, any work completed will be handed over upon final payment settlement. However, any unfinished work remains the intellectual property of Gotarneaasa Technologies unless otherwise agreed.
